Environmental Litigation
Our environmental litigators have handled cases involving alleged violations of environmental regulations, trespass and nuisance claims, injunctions, and personal injury and property damage claims. These claims run the gamut from government enforcement for alleged air, water, and land-based pollution, to contribution suits and environmental review for land development projects. We handle CERCLA-related matters, as well as putative class actions and mass tort cases with environmental contamination claims. We pair this litigation experience with broad knowledge of environmental standards, always keeping apprised of regulatory changes addressing pollution and remediation requirements. Our environmental team negotiates and interfaces with governmental agencies, counsels clients on environmental regulations, and helps clients navigate emergency responses and action plans.
We have experience managing a wide array of environmental claims from pre-suit investigations, governmental enforcement actions, individual lawsuits, and consolidations of cases. RSHC environmental lawyers lead defense efforts across jurisdictions and coordinate with local counsel to defend our clients anywhere they face accusations. We execute strategic litigation plans that provide real defenses for our clients before judges and juries. That preparedness gives our clients the freedom to explore creative settlements, on their terms.
We offer our clients a serious competitive advantage: we can efficiently litigate and resolve their cases, we can try them successfully, and we can handle any appeal when necessary. Our lawyers have extensive experience managing, negotiating, and resolving claims on a national level — as well as appearing before juries and trying cases to verdict. Our lawyers are equally effective in appellate practice. We have argued before panels in eight federal circuit courts of appeal and in appellate courts in more than a dozen states.
Our lawyers are highly trained negotiators and dealmakers. RSHC engages in proactive education programs on the legal, scientific, and medical issues presented in our cases, as well as negotiation theory, training, and techniques. Our lawyers have been trained by FBI Crisis Negotiation Team members, Harvard Law School’s Program on Negotiation, and federal dispute resolution programs.
